What can be considered discrimination in the work place?

Navigating a new work situation is difficult, especially if you are a minority in the workplace. Unfortunately, discrimination at work still happens but sometimes it may be hard to recognize. There are a variety of categories and types of discrimination. Here is a brief list to help you figure things out.

Categories of discrimination

There are a few legal acts that prohibit discrimination against certain groups of people. Title VII protects discrimination on basis of race, religion, national origin or gender. It also includes prohibition of discrimination against pregnant women.

There are also laws against discrimination based on disability. Some state laws also prohibit discrimination due to immigration status, sexual orientation and gender identity.

Types of discrimination

There are multiple types of discrimination you may be facing. Discriminatory intent or treatment claims can be brought if you are treated poorly by your employer as a member of a protected class. This can include harassment as well as being passed over for a promotion or raise in salary.

Disparate impact is based on employer policies. This claim can be brought to your employer if a practice in your workplace has a worse effect on you than others. An example of this could be a disproportionate strength requirement that is designed to favor males over females.

There are many different kinds of discrimination, more than can be covered here. You have rights if you are a member of a protected class. If you think you may be discriminated against in your place of work, try to familiarize yourself with the different laws and policies in place that can protect you.
